Why is there a lawsuit?

This class action lawsuit alleged that The Collier Companies Inc. and Paradigm Properties Management Team Inc. violated Florida law by demanding:

 

  • Accelerated rent

  • Accelerated late fees

 

after a residential lease had already ended.

 

The plaintiffs claimed these demands violated the Florida Residential Landlord Tenant Act and the Florida Consumer Collections Practices Act.

 

The companies deny any wrongdoing, but agreed to a $300,000 settlement to resolve the claims and avoid further litigation.

Who qualifies?

The settlement includes two groups of former tenants or guarantors tied to specific Florida student housing properties.

 

Actual Damages Settlement Class

You may qualify for a cash payment if you:

  • Were a former tenant or guarantor

  • Lived at one of the listed properties

  • Received a notice demanding accelerated rent and/or late fees

  • Paid some or all of those charges

  • Made the payment between January 1, 2017 and August 21, 2024

 

Benefits include:

  • A cash refund

  • Waiver and cancellation of remaining accelerated charges

  • Removal of negative credit reporting tied to those fees

 

Injunctive Relief Settlement Class

You may qualify for non-cash relief if you:

  • Were a former tenant or guarantor

  • Received a notice demanding accelerated rent and/or late fees

  • Did not make a payment after receiving the notice

 

Benefits include:

  • Removal of negative credit reporting

  • Defendants will stop trying to collect the unpaid fees

 

This group does NOT qualify for cash payments.

How much can people get?

  • Total settlement fund: $300,000

  • Cash payments are available only to Actual Damages Class Members

  • Payment amounts depend on:

    • The fees paid

    • The number of valid claims submitted

 

The settlement fund also covers:

  • Settlement administration costs (to be determined)

  • Attorneys’ fees and costs (subject to court approval)

  • Service awards of $5,000 each to two class representatives

How to File a Claim

Only Actual Damages Class Members need to file a claim.

  • Complete the paper claim form included with your settlement notice

  • Mail it to the settlement administrator

Claim forms must be postmarked by: February 24, 2026

 

Information required:

  • Last four digits of your Social Security number

  • Address of the property

  • Approximate dates of tenancy

 

Additional documentation may be required for:

  • Name changes

  • Estate claims

  • Address updates (Notice ID and PIN required)

 

Payments will be issued by paper check.

 

Credit report corrections will begin within 45 days of final approval. Cash payments are expected about 60 days after final approval.
