West Bend Mutual Insurance Settlement — Were Your Structural Loss Payments Reduced? You May Qualify for Cash

If you had a West Bend Mutual Insurance structural loss claim in IL, KY, MO, OH, TN, VA, or WI, this new settlement may mean money back in your pocket. Below is the quick, skimmable rundown so you can see if you qualify and file your claim before the February 6, 2026 deadline.

Why This Lawsuit Exists?

The lawsuit alleges West Bend Mutual Insurance improperly deducted “nonmaterial depreciation” (things like labor, overhead, profit) when calculating actual cash value (ACV) payments on structural loss claims.
This allegedly reduced payouts below what policyholders should have received.

West Bend denies all wrongdoing, but agreed to settle to avoid further litigation.

Who Qualifies?

You may be part of the settlement if:

  • You had a personal or commercial property insurance policy issued by West Bend;
  • You made a structural loss claim for property in IL, KY, MO, OH, TN, VA, or WI;
  • West Bend used an Xactimate estimate to calculate ACV;
  • West Bend withheld nonmaterial depreciation OR would have issued an ACV payment but the withholding dropped the loss below the deductible.
