What happened?
The lawsuit alleged that Festival Fun Parks LLC, doing business as Palace Entertainment, failed to properly disclose processing fees before customers selected electronic tickets for purchase on the Splish Splash website.
According to the lawsuit, this violated New York Arts and Cultural Affairs Law § 25.07(4), which requires certain ticket fees to be clearly disclosed before a purchase is made.
Who is eligible?
You may be eligible if all of the following apply:
- You were located in the United States.
- You purchased one or more electronic tickets to Splish Splash waterpark through the official Splish Splash website.
- Your purchase was made between August 29, 2022, and March 5, 2024.
- You paid a processing fee in connection with your ticket purchase.
How much money can you get?
Eligible class members who submit a valid claim can receive a pro rata cash payment.
Your payment will depend on:
- The total amount of processing fees you paid, and
- The total number of valid claims submitted.
The settlement fund totals $1,000,000, with the remaining net settlement fund distributed among approved claimants after court-approved fees, costs, and other expenses.

How to file a claim?
To receive a payment, you must submit a valid claim by Aug. 10, 2026.
