Nations Direct Mortgage $2.875K Data Breach Settlement

Nations Direct Mortgage has agreed to a class action settlement following a December 2023 cyberattack that exposed sensitive personal information. Why is there a lawsuit?

The lawsuit alleged that Nations Direct Mortgage failed to adequately protect customer data, which allowed hackers to access private information, including:

 

  • Names, addresses, and phone numbers

  • Email addresses

  • Dates of birth

  • Social Security numbers

 

NDM denies wrongdoing but agreed to settle to avoid the costs and uncertainty of continuing litigation.

Who qualifies?

You are eligible if you:

  • Live in the United States

  • Received a notice from NDM stating your private information was affected by the December 2023 data breach

 

Additional eligibility:

  • California residents are part of a subclass and may receive an extra cash payment

  • Current or former NDM employees involved in the breach may also submit a claim

How much can people get?

Class members may claim one or more of the following:

  • Credit Monitoring Services – Two years of coverage including $1 million in identity theft insurance, credit monitoring, dark web scanning, and public records monitoring

  • Documented Losses – Up to $2,750 for out-of-pocket expenses such as:

    • Bank or credit card fees

    • Fees for credit reports or freezing/unfreezing credit

    • Postage for contacting banks

    • Unreimbursed fraudulent charges or identity theft losses

  • Lost Time – Up to 2 hours at $25/hour (max $50)

  • California Subclass Payment – One-time $75 cash payment
