If your vehicle was towed from private property by the City of Calverton Park, or if you paid a special tax bill related to one of those tows, you may be eligible for a cash payment from a $425,000 class action settlement.
Unlike many settlements, you must submit a claim to receive money. Eligible class members have until September 4, 2026 to file.
What happened?
The lawsuit claimed the City of Calverton Park and its code enforcer improperly towed vehicles from private property for alleged municipal nuisance ordinance violations without providing adequate notice or an opportunity to challenge the tow.
The lawsuit also alleged the city imposed special tax bills related to those tows in violation of constitutional due process rights.
Who is eligible?
You may be eligible if, between September 25, 2018, and June 26, 2025, either of the following applies to you:
- Your vehicle was towed from private property by the City of Calverton Park for an alleged municipal nuisance ordinance violation.
- You paid a special tax bill related to a vehicle that was towed from private property for an alleged municipal nuisance ordinance violation.
You may qualify for one or both settlement classes.
If you had multiple vehicles towed or paid multiple special tax bills, you may include all incidents on your claim.
How much money can you get?
Payments will vary based on individual circumstances. The settlement administrator will calculate payments using factors such as:
- Whether you recovered your vehicle from the tow lot
- How many days the vehicle remained impounded
- Any towing, release, or storage fees you paid
- Any special tax bill amounts you paid
Payment Structure
- Recovered Vehicle: Payment is based on the length of impoundment and any towing, release, or storage fees paid.
- Vehicle Not Recovered: Eligible class members may receive compensation related to the loss of the vehicle.
- Paid Special Tax Bill: Payment is based on the amount paid toward the special tax bill.
Final payment amounts may be adjusted depending on the number of valid claims submitted and the funds available for distribution.
