Automatic Payments – Country Bank Overdraft Fee $495,000 Settlement

If you had a consumer deposit account with Country Bank for Savings and were charged certain overdraft or nonsufficient funds (NSF) fees between March 12, 2019, and December 31, 2025, you may be eligible for a payment from a $495,000 class action settlement.

No claim form is required. If you’re an eligible class member, you’ll automatically receive a payment if the settlement receives final approval.

Why does this lawsuit exist?

The lawsuit alleged that Country Bank for Savings improperly charged certain overdraft and NSF fees, including:

  • Retry Fees – overdraft or NSF fees charged on items that had already incurred an NSF fee.
  • Account Balance Fees – overdraft fees charged on transactions that did not actually overdraw an account.

Who qualifies for the settlement?

You may be included in the settlement if:

  • You held a consumer deposit account with Country Bank for Savings between March 12, 2019, and Dec. 31, 2025.
  • You were charged and were not refunded or credited for one or more qualifying Retry Fees or Account Balance Fees.

 

The Settlement Administrator identified eligible class members using the bank’s records. If you received a settlement notice by mail or email, you’re likely included.

How much can you receive?

The settlement creates a $495,000 fund.

After court-approved deductions for attorneys’ fees, litigation costs, administration expenses, and service awards, the remaining funds will be distributed to eligible class members. Payments will be made on a pro rata basis, meaning your payment depends on:

  • The total amount of qualifying fees you paid, compared with
  • The total qualifying fees paid by all participating class members.

 

No class member will receive more than the total amount of challenged fees they paid. Depending on your account status, you’ll receive:

  • An account credit if your Country Bank account remains open.
  • A paper check if your account is closed.
  • If an account credit cannot be completed, you’ll receive a check by mail instead.

What are your options?

Do Nothing Automatically receive your payment as an account credit, check, and/or debt forgiveness if the settlement receives final approval. You will also release the claims covered by the settlement. No action required
Object Tell the Court why you disagree with the settlement while remaining part of the settlement. If approved, you’ll still receive your payment. Refer to your official notice for any objection deadline.
Attend the Final Approval Hearing You may attend the hearing regarding final approval of the settlement. August 11, 2026

Do you need to file a claim?

You do not need to file a claim.

If you’re an eligible class member, the Settlement Administrator will automatically issue your payment after the settlement receives final approval and any appeals are resolved.

If you’ve moved or your mailing address has changed since you held your Country Bank account, you should contact the Settlement Administrator to update your information and help ensure your payment reaches you.
