Capital One Affiliate Marketing Class Action Settlement

Affiliate marketers who partnered with merchants that also worked with Capital One Shopping may be eligible for a cash payment from a class action settlement. If you participated in an affiliate commission program during the qualifying time period, you may be able to submit a claim and receive compensation.

This settlement resolves allegations that Capital One Financial Corp., Wikibuy LLC and Wikibuy Holdings LLC improperly received affiliate marketing commissions that should have gone to affiliates. While the companies deny wrongdoing, both sides agreed to settle to avoid the risks and costs of continued litigation.

Why This Lawsuit Exists?

The lawsuit claims Capital One Shopping received affiliate marketing commissions that should have gone to participating affiliates when transactions involved both the affiliate and the Capital One Shopping tool.

Plaintiffs argued that these practices may have been inconsistent with affiliate marketing industry standards.

Capital One denies these allegations, but agreed to settle the case to avoid further legal expenses and delays.

Who Qualifies?

You may qualify if all of the following are true:

  • You are a person or entity in the United States

  • You participated in an affiliate commission program with an online merchant

  • That merchant also partnered with Capital One Shopping

  • You were involved in a transaction where Capital One Shopping was also involved

  • Your participation occurred between January 6, 2020, and December 18, 2025

 

Both individuals and businesses involved in affiliate marketing programs may qualify.

How Much Can You Get?

Payments depend on the type of claim you qualify for and the documentation you provide.

 

Proof Payment

  • Equal to the amount of commissions Capital One Shopping earned on qualifying transactions

  • Applies to transactions posted on or after November 1, 2023

  • Claimants must provide sufficient evidence showing qualifying transactions

 

Alternative Payment

  • Flat $20 payment

  • Available to claimants who can show their affiliate identifier appears in Capital One Shopping data but do not qualify for a proof payment

 

If you qualify for both calculations, you will receive the greater amount. However, claimants cannot receive both payments.

How to File a Claim?

To receive payment, you must submit a claim form.

You will need to provide:

  • Your name and contact information

  • Your Social Security Number or Taxpayer Identification Number

  • Information showing you participated in a qualifying affiliate program

  • Affiliate identifiers such as:

    • Publisher ID

    • Affiliate ID

    • Affiliate links or URLs

    • Click IDs

    • Trade names

 

You must also provide documentation showing you own the affiliate identifiers, which may include:

  • Affiliate dashboard screenshots

  • Commission reports

  • Contracts with affiliate networks

  • Correspondence with affiliate networks

  • Bank statements showing commission payments

  • Sworn declarations

 

Claims can be submitted online or by mail.

Payment options include PayPal, Venmo, Zelle, or a virtual prepaid Mastercard (default).

If approved and no appeals are filed, payments are expected approximately 60 days after final approval.
