Why This Lawsuit Was Filed?

The lawsuit alleges an unauthorized third party accessed sensitive information through a SAG-AFTRA Health Plan employee email account between Sept. 17 and Sept. 18, 2024.

According to the complaint, the exposed information may have included:

  • Names
  • Social Security numbers
  • Health information
  • Insurance information

Plaintiffs claimed SAG-AFTRA Health Plan failed to adequately protect sensitive personal and health information.

SAG-AFTRA denies wrongdoing but agreed to settle the lawsuit to avoid the expense and uncertainty of continued litigation.

Who Qualifies?

You may qualify if:

  • You are a living person
  • You received a mailed notification stating your private information may have been impacted in the SAG-AFTRA data incident
  • The notice related to the Sept. 17–18, 2024, breach

Additional California Resident Benefits

California residents may qualify for enhanced cash benefits if they:

  • Lived in California at any time between Sept. 17, 2024, and July 23, 2026
  • Received the breach notice at a California address

The settlement estimates that the breach impacted approximately 35,592 individuals.

Who Is Excluded?

Excluded individuals include:

  • SAG-AFTRA officers and directors
  • Judges and court staff involved in the case
  • Individuals responsible for the breach
  • Anyone who validly opts out of the settlement

What Can Class Members Receive?

Eligible class members may qualify for multiple settlement benefits.

Out-of-Pocket Loss Reimbursement

Class members may claim up to:
$5,000 for documented unreimbursed losses

Eligible losses may include:

  • Credit monitoring costs
  • Identity theft protection expenses
  • Fraud-related charges
  • Other documented losses related to the breach

     

Losses must:

  • Have occurred between Sept. 17, 2024, and July 23, 2026
  • Not already be reimbursed by another source

     

Supporting documentation is required.

Pro Rata Cash Payment

Class members can also submit a claim for a cash payment from the remaining settlement funds after approved expense claims are paid.

Payments are based on a share system:

  • California residents receive two shares
  • Non-California residents receive one share

     

     

The final payment amount depends on the number of valid claims submitted.

Automatic Credit Monitoring

All settlement class members will automatically receive:

  • 18 months of CyEx Medical Shield Complete
  • OR CyEx Minor Defense for minors

Benefits include:

  • Medical and healthcare fraud monitoring
  • Single-bureau credit monitoring
  • Identity protection services

No claim form is required for this benefit.

  • Your Class Member ID from the settlement notice

Documentation Requirements

Claims for out-of-pocket losses require proof such as:

  • Receipts
  • Invoices
  • Bank statements
  • Credit card statements
  • Documentation of fraud or identity theft

Claimants must also show:

  • The losses were likely caused by the data breach
  • They were not reimbursed elsewhere
  • Reasonable efforts were made to seek reimbursement

When Will Payments Be Sent?

According to the settlement website, payments are expected to be issued approximately:

  • 30 days after claim processing is completed, or
  • 60 days after final court approval

whichever occurs later.
