Panda Restaurant Group, Inc. has agreed to pay $2.45 million to settle a class action lawsuit over a March 2023 data security incident that may have exposed sensitive personal information, including names, dates of birth, and Social Security numbers. The company denies wrongdoing but agreed to settle to avoid further litigation.

Why This Lawsuit Exists?

The lawsuit alleges that in or around March 2023, an unauthorized third party may have accessed files containing sensitive personal information.

Plaintiffs claimed:

  • Negligence
  • Breach of implied contract
  • Unjust enrichment
  • Breach of fiduciary duty

Panda Restaurant Group denies these claims but agreed to a class-wide settlement.

The incident impacted approximately 240,295 individuals.

Who Qualifies?

You may be included if:

  • You reside in the United States, and
  • Your personal information was accessed or potentially accessed in connection with the March 2023 incident, and/or
  • You received a notice letter about the data breach.

This includes current or former employees and other affected individuals.

How Much Can You Get?

Eligible class members can choose from the following benefits:

1. Documented Loss Payment

Up to $5,000 per person for documented, unreimbursed losses related to the data breach.

Covered expenses may include:

  • Credit monitoring costs
  • Bank fees or late fees
  • Unauthorized charges
  • Identity theft losses

Documentation is required.

2. Alternative Cash Payment

Estimated at $100 (no documented losses required).

Final amount may increase or decrease depending on:

  • Number of claims filed
  • Attorneys’ fees and costs
  • Administrative expenses

3. California Additional Payment

California residents may receive an additional estimated $125.

4. Credit Monitoring

All class members may elect two years of three-bureau credit monitoring, including:

  • Real-time monitoring
  • Dark web scanning
  • Public records monitoring
  • Identity theft insurance
  • Fraud resolution support

How to File a Claim?

To receive benefits, you must submit a claim by April 10, 2026.

You will need:

  • The Unique ID and PIN from your notice
  • Documentation (if claiming losses up to $5,000)

Payments will be issued after final court approval and the completion of claim processing.
