If you received a notice that your personal information was affected by the February 2024 EMM Loans data breach, you may be eligible for benefits through a class action settlement.
Depending on your situation, you could receive up to $4,000 for documented losses, choose a $50 alternative cash payment, and enroll in two years of identity protection and credit monitoring.
Why this lawsuit exists?
The lawsuit alleged that a targeted cyberattack on EMM Loans’ computer systems in February 2024 exposed sensitive personal information, including:
- Names
- Social Security numbers
- Driver’s license or state ID numbers
- Passport numbers
The plaintiff claimed EMM Loans failed to adequately protect this information.
Who qualifies?
You may qualify if:
- You reside in the United States, and
- Your personally identifiable information (PII) was involved in the February 2024 data incident, including individuals who received a notice about the breach from EMM Loans.
Certain individuals are excluded from the settlement, including EMM Loans and related parties, the judge assigned to the case and their immediate staff, and anyone who validly opts out.
How much can you receive?
Eligible class members may choose credit monitoring plus one of two cash benefit options.
Option 1: Up to $4,000 for Unreimbursed Economic Losses
You may claim reimbursement of up to $4,000 for documented losses related to the data breach, including:
- Identity theft or fraud losses
- Credit monitoring expenses
- Credit report or credit freeze fees
- Costs to replace identification documents
- Postage for contacting financial institutions
This option also includes compensation for lost time:
- Up to 3 hours
- $30 per hour
- Maximum of $90
- No documentation is required for lost time, but you must certify the time was spent responding to the incident.
Option 2: $50 Alternative Cash Payment
If you are not claiming reimbursement for economic losses or lost time, you may instead choose a one-time $50 cash payment.
No proof or explanation is required to request this payment.

How to file a claim?
To receive any settlement benefits, you must submit a valid claim.
You can file online, or download and complete a paper claim form and submit it by email or mail.
When filing online, you’ll need the Unique ID and PIN included with your settlement notice. If you can’t locate them, you can contact the Settlement Administrator to request your information.
If you’re claiming out-of-pocket losses, include supporting documentation such as:
- Bank or credit card statements
- Receipts
- Invoices
- Documentation showing fraud or identity theft related to the data breach
If you’re claiming lost time, provide a brief description of how you spent the time responding to the incident.
