A $2.7 million settlement is now available for people who received prerecorded calls from Western Express on a cellphone number they never provided to the company. If a recycled or reassigned number you picked up was previously tied to someone else, and Western Express called you, you may qualify for up to $120.
Here’s the quick breakdown so you can see whether you’re eligible and how to claim your payment before the deadline.
Why is there a lawsuit?
The lawsuit, Javarius Puckett v. Western Express, Inc. (Case No. 25C1496), claims that Western Express violated the Telephone Consumer Protection Act (TCPA) by sending prerecorded calls to cellphone numbers without the required consent.
Specifically, these calls went to numbers that had been previously assigned to another person, someone who had given their number to Western Express, while the new owner of the number (possibly you) never gave permission.
Western Express denies violating the TCPA, but it agreed to the $2,718,945 settlement to resolve the claims and avoid further litigation.
Who qualifies?
To be included in the settlement, these conditions must apply:
Your telephone number was assigned to a cellphone at any time between May 28, 2020 and Sept. 19, 2025.
You received at least one prerecorded call from Western Express during this period.
You did NOT provide your number to Western Express or its vendors.
You never submitted your number through any job application or employment-related website connected to Western Express.
Your number was previously assigned to another person who did provide it to Western Express.
The class covers an estimated 14,697 phone numbers.
How much can people get?
Eligible class members will receive a pro rata cash payment of up to $120.
Payment is per person, not per call
The final amount depends on how many valid claims are filed
Payments will be mailed as paper checks.
