Why is there a lawsuit?

The lawsuit stems from a February 2023 data incident in which an unauthorized third party accessed Sweetwater’s network. Files containing sensitive information may have been exposed, including:

  • Social Security numbers

  • Dates of birth

  • Driver’s license or passport numbers

  • Financial account information

  • Online account usernames/passwords

  • Health insurance details

 

Sweetwater denies wrongdoing but agreed to settle to avoid continuing litigation.

Who qualifies?

You’re part of the settlement if:

  • You live in the United States, and

  • Your personal information was involved in the February 2023 Sweetwater data breach, and

  • You received a notice letter about the data incident (sent around June 2023), and

  • You are a current or former student, employee, or a parent/guardian of a student under 18.

 

All four must be true to qualify.

How much can people get?

Eligible class members may claim one or more of the following:

 

• Up to $5,000 for documented out-of-pocket expenses
Includes fees, credit monitoring, replacement cards, overdraft fees, etc.

 

• Up to $5,000 for verified fraud
Includes fraudulent tax filings, government benefits claims, or unauthorized accounts. (Counts toward the same $5,000 combined cap as out-of-pocket expenses.)

 

• Up to $100 for lost time
Up to four hours at $25/hour for time spent dealing with issues caused by the breach. May be reduced depending on the number of valid claims.

 

• One year of free CyEx credit monitoring
Available to all claimants who submit a valid claim number.

 

Maximum total cash compensation (including lost time + fraud/out-of-pocket): $5,100.
