Why Did This Lawsuit Happen?
The lawsuit alleges that Hillcrest Convalescent Center Inc. failed to adequately protect sensitive personal and health information during a cyberattack that occurred in June 2024.
According to the lawsuit, the incident may have exposed information including:
- Names
- Addresses
- Social Security numbers
- Financial account information
- Dates of birth
- Driver’s license and other government-issued ID numbers
- Medical treatment and health insurance information
Who Qualifies for the Settlement?
You may qualify if:
- You are a living individual residing in the United States, and
- Your private information was potentially impacted in the June 2024 Hillcrest Convalescent Center data incident.
Settlement Class Members are divided into two groups:
- Group 1: Your Social Security number was among the information potentially impacted.
- Group 2: Your Social Security number was not among the information potentially impacted.
How Much Can You Receive?
Depending on your eligibility and the option you choose, you may receive one of the following:
Option A – Documented Losses (All Class Members)
You may claim up to $2,500 for documented out-of-pocket losses related to the data breach.
Eligible expenses may include:
- Identity theft or fraud losses
- Credit report or credit monitoring fees
- Credit freeze or unfreeze fees
- Costs to replace identification documents
- Postage for contacting financial institutions
The losses must have occurred between June 27, 2024, and August 26, 2026, and must be supported with documentation such as receipts or bank statements.
Option B – Alternative Cash Payment (Group 1 Only)
If you are a Group 1 Settlement Subclass Member, you may choose a one-time cash payment of approximately $50 instead of the other available benefits. No documentation is required for this option.
Credit Monitoring (All Class Members)
All Settlement Class Members may enroll in two years of CyEx Identity Defense Complete, which includes:
- Real-time credit monitoring
- Dark web monitoring
- Public records monitoring
- $1 million identity theft insurance
- Fraud resolution support
If total claims exceed the available settlement funds, cash payments may be reduced on a pro rata basis.

How to File a Claim?
To receive settlement benefits:
- Confirm that you received a settlement notice or are a Settlement Class Member.
- Decide which benefit you’re claiming:
- Up to $2,500 in documented losses
- $50 alternative cash payment (Group 1 only)
- Two years of credit monitoring
- Complete the online Claim Form using your Unique ID and PIN, or download and mail a paper claim form.
- If claiming documented losses, include supporting documentation such as receipts, bank statements, or other records showing your losses were related to the data incident.
- Submit your claim no later than August 26, 2026.
