If you worked as a nonexempt, hourly employee for Robertson’s Transport Ltd. in California between Nov. 5, 2021, and July 30, 2025, you may be eligible for a payment from a $1.4 million class action settlement.
The good news? No claim form is required. If you’re an eligible employee, your payment will be sent automatically unless you choose to opt out.
Why this lawsuit exists?
The lawsuit alleged that Robertson’s Transport violated California wage-and-hour laws by failing to properly compensate employees.
The claims included allegations involving:
- Unpaid overtime and minimum wages
- Missed meal and rest breaks
- Failure to provide accurate wage statements
- Failure to pay sick pay and wages upon termination
- Failure to reimburse business expenses
- Claims for civil penalties under the California Private Attorneys General Act (PAGA)
Who qualifies?
The settlement includes two groups of employees.
Class Members
You may qualify if you were employed by Robertson’s Transport Ltd. (directly or through a subsidiary, staffing agency, joint venture, or professional employer organization) as a nonexempt, hourly-paid employee in California between Nov. 5, 2021, and July 30, 2025.
Aggrieved Employees (PAGA)
You may also qualify for a PAGA payment if you worked as a nonexempt, hourly-paid employee during the PAGA period of Aug. 14, 2022, through July 30, 2025.
Some employees may qualify for both a Class payment and a PAGA payment.
How much can you receive?
The settlement fund totals $1,400,000, but individual payments will vary.
Your payment depends on:
- The number of workweeks you worked during the Class Period.
- The number of pay periods you worked during the PAGA Period (if applicable).
Eligible employees may receive:
- An Individual Class Payment, based on qualifying workweeks.
- An Individual PAGA Payment, if they qualify as an Aggrieved Employee.
The settlement allocates $50,000 to PAGA penalties, with:
- $12,500 distributed to eligible Aggrieved Employees.
- $37,500 paid to the California Labor and Workforce Development Agency.
Your options
| Your Option | What It Means | Deadline |
|---|---|---|
| Do Nothing | Receive your eligible Class Payment and/or PAGA Payment automatically. By remaining in the settlement, you release the covered claims. | No action required |
| Challenge Your Workweek or Pay Period Calculation | If you believe the workweeks or pay periods listed in your notice are incorrect, you may submit a written challenge with supporting documentation. | July 24, 2026 |
| Opt Out of the Class Settlement | Exclude yourself from the Class Settlement and keep your right to pursue your own wage claims. If you qualify as an Aggrieved Employee, you will still receive any eligible PAGA payment because the PAGA portion cannot be opted out of. | Aug. 10, 2026 |
| Object to the Settlement | Tell the Court why you disagree with the proposed settlement if you remain a participating Class Member. | Aug. 10, 2026 |
| Attend the Final Approval Hearing | You may attend the Court hearing regarding final approval of the settlement. | Sept. 16, 2026 |
How to file a claim?
You do not need to file a claim.
- If you are an eligible Class Member or Aggrieved Employee, the Settlement Administrator will automatically mail your payment to the address on file.
- If you’ve moved since working for Robertson’s Transport, you should update your mailing address as soon as possible to avoid missing your payment.
- If you believe your notice understates the number of qualifying workweeks or pay periods you worked, submit a written challenge with supporting documentation by July 24, 2026.
Settlement checks are expected to be mailed approximately 45 days after the Court grants final approval and any appeals are resolved.
If you worked for Robertson’s Transport in California during the covered period, review your settlement notice, confirm your mailing address is current, and make sure your workweek and pay period information is accurate before the deadlines.
