Why the Lawsuit Exists?
Plaintiffs allege that PHH Corp., PHH Mortgage Corp., PHH Home Loans, LLC, and Atrium Insurance Corp. violated laws prohibiting kickbacks tied to private mortgage insurance. The lawsuit claims these kickbacks were included in PHH’s captive mortgage reinsurance agreements.
PHH denies wrongdoing. The Court has not decided who is right. Instead, the parties agreed to a settlement of $875 per qualifying loan to avoid further litigation.
