Kickback Jack’s $1.1 Million Sex Discrimination Settlement

The settlement resolves allegations that Kickback Jack’s engaged in discriminatory hiring practices. If you qualify, you’ll need to submit a claim by Aug. 3, 2026 to be considered for a payment.

If you’re a man who applied for a nonmanagerial front-of-house position at Kickback Jack’s and believe you weren’t hired because of your sex, you may be eligible to receive a cash payment from a $1,111,300 settlement.

What happened?

The Equal Employment Opportunity Commission (EEOC) filed the lawsuit, alleging that Kickback Jack’s had a policy or practice of intentionally not hiring male applicants for nonmanagerial front-of-house positions in violation of Title VII of the Civil Rights Act of 1964.

The lawsuit claimed the alleged hiring practices occurred from at least Jan. 1, 2019, through Feb. 3, 2026.

Who is eligible?

You may be eligible if all of the following apply:

  • You are male.
  • You applied for a nonmanagerial front-of-house position at a Kickback Jack’s restaurant owned or operated by Battleground Restaurants Inc. or Battleground Restaurant Group Inc.
  • You applied between Dec. 1, 2019, and Feb. 3, 2026.
  • You were not hired for the position.
  • You believe you were not hired because of your sex (male).

 

The EEOC will review the information submitted with your claim to determine eligibility and any payment amount.

How much money can you get?

The settlement creates a $1,111,300 fund for eligible claimants. Because payments will be divided among qualifying class members, there is no fixed payout amount.

 

Your payment will depend on:

  • The number of valid claims submitted.
  • The EEOC’s determination of your eligibility.
  • The EEOC’s assessment of your damages.

How to file a claim?

To be considered for compensation, you must submit a completed claim form by Aug. 3, 2026. You can submit your claim online, or download, complete, and mail a paper claim form.

 

The claim form asks for information about:

  • Your contact information
  • Your application for employment
  • The position you applied for
  • The circumstances surrounding your non-selection

 

You’ll also be asked to:

  • Upload a clear image of your driver’s license or government-issued ID
  • Sign the claim under penalty of perjury

 

If your contact information changes after filing, notify the Settlement Administrator as soon as possible to help ensure you receive any payment you’re entitled to.
