If you paid a tobacco surcharge through the Navistar or International Motors health plan between Jan. 1, 2016, and Dec. 31, 2025, you may be eligible to receive money from a $150,000 class action settlement.
The settlement resolves claims that International Motors LLC (formerly Navistar Inc.) allegedly violated the Employee Retirement Income Security Act of 1974 (ERISA) by administering a wellness program that did not provide a reasonable alternative standard for its tobacco surcharge policy.
No claim form is required to receive a settlement payment. Eligible class members may submit a payment election form if they want to choose an electronic payment option.
Why Did This Settlement Happen?
A class action lawsuit was filed against International Motors LLC involving its employee health plan’s tobacco surcharge policy.
The lawsuit alleged that the company’s wellness program discriminated against employees by failing to provide a reasonable alternative standard for the tobacco surcharge, as required under ERISA.
International Motors denied the allegations and denied any wrongdoing. The company agreed to settle the case to avoid the cost and uncertainty of continued litigation.
Who Qualifies for the Settlement?
You may be eligible if you meet all of the following requirements:
✔️ You are or were a participant in the Navistar health plan, now known as the International Motors health plan
✔️ You participated in the plan while residing in the United States
✔️ You paid a tobacco surcharge during the period: Jan. 1, 2016, through Dec. 31, 2025
How Much Can Class Members Receive?
International Motors has agreed to pay:
$150,000 into a Qualified Settlement Fund
Eligible class members will receive a pro rata cash payment from the remaining settlement funds after deductions for approved expenses, including:
Settlement administration costs
Independent fiduciary fees (up to $25,000)
Attorneys’ fees and expenses (up to $49,950)
Case contribution award to the class representative (up to $5,000)
Applicable tax withholdings

Do I Need to File a Claim?
No. A claim form is not required.
Eligible class members will receive a payment directly from the settlement administrator.
However, you may submit a payment election form if you want to choose an electronic payment method.
You will need the ID and confirmation code from your settlement notice to complete a payment election.
