Why This Lawsuit Exists?

The case, Benavides, et al. v. HopSkipDrive Inc., stems from a cybersecurity incident that occurred between May 31, 2023, and June 10, 2023.

According to the lawsuit:

  • An unauthorized third party accessed certain database files.
  • The compromised information allegedly included:
    • Names
    • Addresses
    • Dates of birth
    • Driver’s license numbers
    • Social Security numbers
    • Medical information

HopSkipDrive denies wrongdoing but agreed to establish a $1,985,000 settlement fund to resolve the claims.

Who Qualifies?

You may be included if:

  • Your private information may have been compromised in the HopSkipDrive data security incident, AND
  • You received notice that your information was affected.

How Much You Can Get?

Eligible class members who submit a valid claim may receive:

1. Documented Losses
  • Up to $5,000 for documented out-of-pocket losses related to the breach.

2. Lost Time
  • Up to 5 hours at $25 per hour
  • Maximum $125

3. Additional Cash Payment
  • $100 (subject to pro rata adjustment)

4. California Statutory Payment
  • California residents may receive up to $250 (subject to pro rata adjustment)

5. Identity Protection
  • Two years of Expanded Identity Theft and Fraud Monitoring
    • Three-bureau credit monitoring
    • Up to $1 million in fraud and identity theft insurance
    • Access to a dedicated fraud specialist

Payments may increase or decrease depending on the number of valid claims and available funds.
