Francesca’s Data Breach Settlement – Compensation Available

If you were a UnitedHealthcare member in North sCarolina between 2016 and 2021, you may be owed money back for out-of-network medical bills you shouldn’t have had to pay. Thanks to a $3.4 million settlement with the North Carolina Department of Insurance (NCDOI), eligible members can now claim reimbursement — plus interest — for those extra payments.

Why is there a lawsuit?

In January 2023, hackers accessed Francesca’s network and files. Sensitive information — including names, addresses, Social Security numbers, driver’s license numbers, and financial account details — was compromised.

 

A class action lawsuit claimed Francesca’s could have prevented the breach with stronger security. While Francesca’s denies wrongdoing, the company agreed to a settlement to resolve the claims.

Who qualifies?

You’re included if:

 

  • You lived in the U.S.

  • Your personal information was compromised in the January 2023 breach, and

  • You received a data breach notice from Francesca’s on or after Sept. 25, 2023.

How much can people get?

  • Ordinary losses: Up to $1,500 for expenses like bank fees, credit monitoring, or communication costs.

  • Lost time: Up to 5 hours at $25/hour (max $125), included in the $1,500 cap above.

  • Extraordinary losses: Up to $5,000 for unreimbursed, documented losses linked to the breach.

  • Alternative cash payment: $50, or $75 if you lived in California at the time.

  • Credit monitoring: Two years of free, three-bureau monitoring (available to all class members).

 

Depending on your situation, you could claim up to $6,500 total.

How to File a Claim

If you received a Francesca’s data breach notice, you could get cash, reimbursement, or credit monitoring — but only if you file before the deadline.

 

Fill out the claim form online or by mail. Provide documentation of losses (bank statements, receipts, etc.), if claiming reimbursement.
