If you received promotional emails from Costco while living in Washington state, you may be eligible for a cash payment from a $14 million class action settlement.
To receive money, you’ll need to submit a valid claim by August 24, 2026. Even if you received a settlement notice, filing a claim is required to get paid.
Why Did This Lawsuit Happen?
The lawsuit alleges that Costco Wholesale Corporation sent commercial email messages to Washington residents with false or misleading subject lines, allegedly violating Washington’s Commercial Electronic Mail Act and Consumer Protection Act.
According to the lawsuit, some promotional emails advertised limited-time offers but allegedly extended those promotions beyond the time stated in the subject line.
Who Qualifies for the Settlement?
You may qualify if all of the following apply:
- You received one or more commercial email messages sent by or on behalf of Costco.
- You were a Washington resident when you received the email(s).
- The email(s) were sent between June 2, 2021, and July 7, 2026.
- The email address where you received the messages appears in Costco’s records.
Examples of qualifying emails may include subject lines such as:
- “Today is the last day to access Member-Only Saving”
- “Hot Buys available for 5 Days Only”
If you received a notice about this settlement by mail or email, Costco’s records indicate you are likely a Settlement Class Member. However, you may still qualify even if you did not receive a notice, provided you meet the eligibility requirements.
How Much Can You Receive?
Eligible class members who submit a valid claim will receive a pro rata cash payment.
The exact payment amount depends on:
- The total number of valid claims submitted
- Court-approved attorneys’ fees and expenses
- Settlement administration costs
- Any approved service award to the class representative
Because the number of claims is not yet known, the final payment amount cannot be determined at this time.
