Why this lawsuit exists?
The lawsuit alleges that Clackamas County:
Did not return surplus proceeds after selling tax-foreclosed properties, or
Kept properties worth more than the tax debt without compensating the original owners
These are often called “surplus-proceeds claims.”
Clackamas County denies wrongdoing, but agreed to settle to avoid ongoing litigation and risk.
Who qualifies??
You may be eligible if you:
Owned property (or had an ownership interest), or
Held a valid lien on a property, or
Are you an heir, successor, or assignee of someone who did
AND
The property was foreclosed on by Clackamas County for unpaid taxes
The redemption period expired between Oct. 12, 2017 and Jan. 12, 2024
The property is listed in the settlement’s eligible property list (Exhibit A)
The county:
Sold the property for more than what was owed, or
Still owns it and may sell it for more than the debt
How much can you get?
Pro rata cash payment (a share of the net settlement fund)
Your final amount depends on:
Number of valid claims filed
Whether others claim the same property
If multiple people claim the same property, the payment will be split (divided among claimants).
In some cases, if the county still owns the property, you may have the option to redeem it by paying the taxes, costs, and interest.
