Why This Lawsuit Exists?

In October 2023, Brodart Co.’s computer systems were targeted in a cyberattack, exposing sensitive personal information. The breach potentially included:

  • Names, addresses, and dates of birth

  • Social Security numbers and government-issued ID numbers

  • Financial account information and credit/debit card details

  • Phone numbers and medical information

 

The lawsuit claimed Brodart failed to protect this data. Brodart denies wrongdoing but agreed to settle to avoid the costs and uncertainties of litigation.

Who Qualifies?

You may be part of the settlement if you:

  • Lived in the United States at the time of the breach, and

  • Your workers’ compensation audit file contained an unredacted Social Security number that may have been exposed in October 2023.

How Much Can You Get?

Eligible class members can claim:

 

  1. Out-of-pocket expenses: Up to $1,000 for documented costs such as credit reports, credit monitoring, ID replacement, or postage.

  2. Lost time: Up to 4 hours at $20/hour (max $80) for time spent on breach-related tasks like changing passwords or monitoring accounts. Counts toward the $1,000 out-of-pocket cap.

  3. Identity theft or fraud losses: Up to $2,500 for documented monetary losses caused by the breach, not already covered above.

  4. Alternative cash payment: $45 if you do not claim the above. No documentation required.

  5. Credit monitoring services: One year with all three credit bureaus, $1 million identity theft insurance, real-time monitoring, dark web scanning, and fraud resolution support.
