Automatic Payments – Banana Republic $1.95 Million Labor Class Action Settlement

If you worked as a nonexempt retail store employee for Banana Republic or The Gap in California between Oct. 27, 2022, and July 4, 2025, you may be entitled to a payment from a $1.95 million class action settlement.

The settlement resolves claims that Banana Republic LLC and The Gap Inc. violated California labor laws involving wages, meal and rest breaks, wage statements, expense reimbursements, and other employment-related issues.

What happened?

The lawsuit alleged that Banana Republic LLC and The Gap Inc. failed to comply with various California labor laws, including claims involving:

  • Unpaid minimum wages and overtime
  • Missed meal and rest breaks
  • Inaccurate wage statements
  • Unreimbursed business expenses
  • Late wage payments
  • Sick pay violations
  • Related labor law penalties

Who is eligible?

You may be included in the settlement if you:

  • Worked for Banana Republic LLC or The Gap Inc.
  • Were a nonexempt retail store employee
  • Worked in California
  • Worked at any time between Oct. 27, 2022, and July 4, 2025

 

Even employees who worked only a single day during the class period may be included.

How much money can you get?

Payments will vary based on the number of pay periods worked during the class period. Eligible workers may receive:

  • A class settlement payment based on their qualifying pay periods
  • An additional PAGA payment if they qualify as an aggrieved employee during the PAGA period

 

The settlement administrator will calculate each person’s share using payroll records and the total number of qualifying pay periods worked by participating class members. The net settlement fund available to workers is estimated to be at least $1,132,000 after court-approved deductions.

How to file a claim?

Good news: No claim form is required.

If the company’s records identify you as a class member, the settlement administrator will automatically mail a check to your address on file after final approval.

If your mailing address has changed, contact the settlement administrator promptly.
