If you owned property in Wisconsin and filed a structural damage claim with American Family Insurance, you may be eligible for money from a new class action settlement. The case resolves allegations that American Family wrongly deducted nonmaterial depreciation from some claim payments. Eligible policyholders could receive $10–$200 or more, but a claim must be filed by December 1, 2025 to qualify.
Why This Lawsuit Exists
Homeowners in Wisconsin said American Family improperly deducted “nonmaterial depreciation” from their structural loss payments — money that shouldn’t have been withheld.
The case, Bradley Martin et al. v. American Family Mutual Insurance Co., S.I. (No. 2025-LA-0000021), claims this practice reduced payouts unfairly.
American Family denies wrongdoing, but it has agreed to settle to resolve the case.
Who Qualifies
You may be eligible if you:
Had an American Family property insurance policy in Wisconsin
Filed a structural loss claim under Coverage A or B
Had an Xactimate estimate used to calculate your payment
Had nonmaterial depreciation withheld from your payment
The claim was made between Nov. 2, 2019, and May 15, 2025
How Much You Can Get
Payments will vary depending on how much nonmaterial depreciation was withheld from your structural loss payment.
If depreciation was withheld and later repaid, you may receive a cash payment between $10 and $200. If depreciation was withheld and never repaid, your payment amount will be based on the total depreciation that was deducted.
Exact payment amounts depend on your individual claim details.
