Official Rules – Class Actions from Mode Read & Win Sweepstakes

APPLICATION TO READ & WIN SWEEPSTAKES:
These Official Rules govern the prize sweepstakes sponsored by Mode Mobile, LLC, a Delaware limited liability company (“Sponsor” or “Mode”), associated with its Class Actions from Mode Read & Win email initiative (the “Sweepstakes”).
Participation constitutes the entrant’s full and unconditional agreement to and acceptance of these Official Rules and creates a binding contract between Mode and the entrant.
Each Read & Win Sweepstakes begins and ends at the times and dates specified on the applicable Read & Win offer page located within the ModeFreeFinds.com website (the “Website”) (the “Sweepstakes Period”). Unless otherwise specified, entries are first accepted at 12:00:01 A.M. Central Standard Time (“CST”) on Monday and are not accepted after 11:59:59 P.M. CST on Sunday of the same week.
1. ELIGIBILITY
The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia, who are 18 years of age or older at the time of entry.
Persons in any of the following categories are not eligible to participate or win prizes in this Sweepstakes:
(a) directors, officers, employees, agents, or independent contractors of Mode Mobile, LLC or its parent company, subsidiaries, affiliates, or service agencies;
(b) individuals engaged in the development, production, or distribution of the Sweepstakes materials or prize supply; and
(c) immediate family members (defined as spouse, IRS dependents, or biological, adoptive, or stepmother, father, sister, brother, daughter, or son, and each of their respective spouses) or household members of any person in the preceding categories.
This Sweepstakes is void in Florida and wherever prohibited or restricted by law.
2. HOW TO ENTER
To enter a Read & Win Sweepstakes via the Class Actions from Mode Website, an individual must:
- Be subscribed to the Class Actions from Mode daily email newsletter;
- Open and read a Class Actions from Mode email during the Sweepstakes Period;
- Follow the link provided in the “Thanks for Reading” email that appears after reading a Class Actions from Mode email; and
- Submit their email address on the Read & Win confirmation form (the “Entry Form”).
Each completed Entry Form equals one (1) valid entry per day during the Sweepstakes Period.
Entries must be received during the applicable Sweepstakes Period to be eligible. Once submitted, an entry cannot be deleted, canceled, or modified.
Any attempt by an entrant to obtain more than the stated number of entries by using multiple or different identities, registrations, or any other methods will void that entrant’s entries and that entrant may be disqualified.
Any personally identifiable information collected by Sponsor during an entrant’s participation may be used by Sponsor and its affiliates for the proper administration and fulfillment of the Sweepstakes as described in these Official Rules.
Sponsor reserves the right, in its sole discretion, to void any or all entries of a participant whom it believes has attempted to tamper with, influence, or impair the administration, security, or fairness of the Sweepstakes.
By participating, entrants agree to be bound by these Official Rules, and Sponsor’s decisions are final and binding in all matters related to the Sweepstakes.
3. PRIZES
For each weekly Read & Win Sweepstakes, one (1) winner will receive an Amazon Gift Card with a value of up to $50 USD (the “Prize”).
Odds of winning depend on the total number of eligible entries received during the Sweepstakes Period.
Sponsor may, at its discretion, increase the Prize value if total entries during the Sweepstakes Period reach participation thresholds announced on the Website or in related promotional materials.
No cash or other prize substitution is permitted except at Sponsor’s discretion. Odds of winning depend upon the total number of eligible entries received.
Prizes will be sent directly by Class Actions from Mode via email within ninety (90) days of winner verification.
4. DRAWINGS AND NOTIFICATION
A random drawing will be conducted by Sponsor within approximately two (2) weeks after the end of each Sweepstakes Period from among all eligible entries received.
The potential winner will be notified by email using the address submitted via the Entry Form. If the potential winner cannot be contacted within three (3) calendar days of the first notification attempt, fails to respond within the required timeframe, or is found to be ineligible, an alternate winner may be selected.
All drawings are conducted by the Sponsor, whose decisions are final and binding in all matters related to the Sweepstakes. The odds of winning depend on the total number of eligible entries received during the Sweepstakes Period.
5. PRIZE VERIFICATION & CONDITIONS
A potential winner will be confirmed only after Sponsor verifies eligibility and compliance with these Official Rules.
Winners must be willing and able to claim and accept the Prize within the timeframe specified by Sponsor.
Failure to meet eligibility requirements or to respond to communications from Sponsor may result in disqualification and selection of an alternate winner.
In all matters related to administration, operation, drawing, and verification, Sponsor’s decisions are final and binding.
If a prize or prize notification is returned as undeliverable, or a potential winner cannot be reached, the prize may be forfeited, and an alternate winner may be selected.
Prizes will be delivered within ninety (90) days following the end of the applicable Sweepstakes Period.
6. GENERAL CONDITIONS
By accepting a prize, where permitted by law, the winner grants Sponsor and its affiliates the right to print, publish, broadcast, and use worldwide—in all media and formats—the winner’s first name, last initial, city, state, likeness, and/or biographical information for advertising or promotional purposes without additional payment, notice, or approval.
Entrants agree to release and hold harmless Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, dealers, distributors, suppliers, and their respective directors, officers, employees, representatives, and agents from any and all liability, injuries, losses, or damages of any kind arising from participation in this Sweepstakes or the acceptance, possession, use, or misuse of any prize.
Sponsor is not responsible for any technical, hardware, or software failures, lost connections, or unauthorized access that may interfere with participation. Sponsor reserves the right to cancel, suspend, or modify the Sweepstakes if technical problems or other causes compromise its integrity.
7. INTERNET LIMITATIONS OF LIABILITY
If, for any reason, the Sweepstakes is not capable of running as planned due to infection by virus, bugs, tampering, unauthorized intervention, fraud, or other technical failures, Sponsor reserves the right to cancel, terminate, modify, or suspend the Sweepstakes, in whole or in part, at any time without notice.
Sponsor is not responsible for any error, omission, interruption, deletion, defect, delay in operation, communications failure, or unauthorized access to entries.
Any attempt to deliberately damage the Website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws. Sponsor reserves the right to seek damages to the fullest extent permitted by law.
8. USE OF DATA
All information submitted by entrants will be handled in accordance with Sponsor’s Privacy Policy.
By participating, entrants consent to Sponsor’s collection, use, and disclosure of their personal information for the purpose of administering the Sweepstakes and sending Class Actions from Mode emails.
9. DISPUTES
Except where prohibited, entrants agree that any and all disputes, claims, or causes of action arising out of or connected with this Sweepstakes shall be resolved individually, without resort to class action, and exclusively by the appropriate court located in the State of Illinois.
All issues concerning the construction, validity, interpretation, and enforceability of these Official Rules shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict-of-law principles.
10. TRANSFER
The transfer or assignment of status as a winner is strictly prohibited.
11. WINNERS LIST
To obtain a winners list, send an email request to [email protected] with the subject line “Request for Class Actions from Mode Read & Win Sweepstakes Winner List.”
The winners list will include the winner’s first name, last initial, and city/state of residence.
