M&D Capital $1M Data Breach Settlement: What You Need to Know

A July 2023 data breach at M&D Capital Premier Billing exposed highly sensitive personal and medical information—including names, addresses, medical billing details, diagnoses, medications, insurance info, dates of birth, and even Social Security numbers. A $1,000,000 class action settlement is now open for claims, and affected individuals may be able to receive up to $5,000, a $75 cash payment, and two years of medical monitoring.

Why is there a lawsuit?

The lawsuit alleges that unauthorized parties accessed systems holding patients’ Private Information in July 2023. Plaintiffs claim M&D Capital failed to implement reasonable data security safeguards, leading to the breach and exposing highly sensitive medical and personal information.

 

M&D Capital and Island Ambulatory Surgery Center deny wrongdoing, but agreed to settle to avoid further litigation.

Who qualifies?

You may be part of the settlement if:

  • Your private information was involved in the data incident discovered on or about July 8, 2023, and

  • You later received a notice of the breach (sent around March 18, 2024).

How much can people get?

Eligible class members can choose from several benefit types:

 

1. Reimbursement for Documented Losses — up to $5,000

You may claim unreimbursed expenses tied to the breach, including:

  • Bank fees

  • Credit monitoring or ID theft insurance costs

  • Gas/postage for credit-related errands

  • Credit report fees

  • Phone/data charges

  • Other reasonable expenses, with documentation

 

2. Flat Cash Payment — $75

How to File a Claim

To receive any settlement benefits, you must file a claim form by January 27, 2026.
