Kitsap Mental Health Services Data Breach Settlement: Up to $3,100 + Monitoring

Why This Lawsuit Exists?

A class action lawsuit alleges that a targeted cyberattack in October 2024 allowed unauthorized access to KMHS systems, exposing sensitive personal and medical information of approximately 70,759 patients.

Compromised data may have included names, addresses, birth dates, Social Security numbers, ID numbers, diagnoses, treatment and medication info, claims data, and financial information.

KMHS denies wrongdoing but agreed to a settlement to avoid the costs and uncertainty of continued litigation.

Who Qualifies?

You may be eligible if:

  • You are a current or former KMHS patient
  • Your personal and/or protected health information may have been compromised
  • You received a notice about the October 2024 KMHS data incident

How Much Can You Get?

Eligible class members can choose one or more of the following benefits:

  • Medical Data Monitoring
    Two years of CyEx Medical Shield Complete, including $1 million in identity theft insurance and monitoring for specific medical data exposure
  • Up to $3,000 for documented out-of-pocket losses
    Covered losses incurred between Oct. 17, 2024 – Feb. 5, 2026, including:
    • Identity theft or fraud losses
    • Credit report/monitoring or credit freeze fees
    • Costs to replace IDs
    • Postage for contacting banks by mail
  • Up to $100 for lost time
    Up to 4 hours at $25/hour for time spent dealing with the breach (password changes, investigating suspicious activity, researching the incident)

How to File a Claim?

To receive benefits, you must submit a valid claim by February 5, 2026.

  • Documentation for out-of-pocket loss claims (bank statements, receipts, invoices, etc.)
