Why Did This Lawsuit Happen?
The lawsuit alleges that FMC Services LLC (FMC Health) failed to adequately protect patients’ personally identifiable information and protected health information during a cybersecurity incident that occurred around July 26, 2022.
Plaintiffs claimed the data breach resulted from inadequate data security and asserted claims including negligence, breach of fiduciary duty, breach of implied contract, and unjust enrichment.
Who Qualifies for the Settlement?

- You received a notice stating that your personally identifiable information or protected health information was potentially compromised in the July 2022 FMC Services data incident, or
- Your information was compromised in the incident and you are part of the Settlement Class.

How to File a Claim?
To request settlement benefits:
- Complete the online Claim Form or download and mail a paper Claim Form.
- Submit your claim no later than August 31, 2026.
- If filing online, enter the Settlement Claim ID found on your settlement notice.
- If claiming documented losses, include supporting documentation such as receipts, invoices, bank or credit card statements, or other records showing unreimbursed expenses related to the data breach.
