If you worked in a call center for Discover, this is one of those settlements you don’t want to skip. A $15,000,000 class action settlement involving Discover Financial Services and Discover Products, Inc. could mean cash in your pocket, and in some cases, you don’t even need to file a claim to get it.
Why This Lawsuit Exists?
The lawsuit claims Discover did not pay hourly call center employees for all time worked. Specifically, employees alleged they were not compensated for:
- Time spent logging into systems before shifts
- Time spent logging out after shifts
This allegedly violated:
- Federal wage laws (including the Fair Labor Standards Act)
- State wage laws
Discover denies all allegations, but agreed to settle to avoid ongoing legal costs and uncertainty.
Who Qualifies?
You may be included if you:
- Worked as an hourly call center employee
- For Discover Products, Inc. or Discover Financial Services
- In the United States
- Between January 9, 2021 and May 31, 2025

How Much Can You Get?
The total settlement fund is $15 million, but your individual payment depends on:
- How many weeks you worked during the class period
- Whether you submit an FLSA opt-in form
Two ways payments are distributed:
1. Rule 23 Payment (Automatic)
- 15% of the net settlement fund
- You’ll automatically receive this if you don’t opt out
- Based on your total weeks worked
- Some states (like CA, IL, NJ, etc.) are weighted 1.2x higher
2. FLSA Payment (Requires Action)
- 85% of the net settlement fund
- You must submit an opt-in form to receive this portion
- Also based on weeks worked
Payments are split for tax purposes:
- 50% wages (W-2)
- 50% damages (1099)
If your calculated payment is under $10, you’ll still receive $10 minimum

How to File a Claim?
Step 1: Check your notice
You should have received a settlement notice and information sheet. Review it carefully. If anything is incorrect (like workweeks), fix it by April 22, 2026.
Step 2: Decide if you want the larger payment
- Want just the automatic payment? Do nothing.
- Want a larger share (FLSA payment)? Submit the FLSA Opt-In Form
