Why This Lawsuit Exists?
The lawsuit claimed that BFI Waste Services LLC and several affiliated companies raised prices for waste hauling and recycling services beyond what certain contracts allowed.
According to the plaintiffs, some contracts allowed price increases only for specific reasons, such as:
Disposal or transportation costs
Consumer Price Index (CPI) increases
Changes in applicable laws
The lawsuit alleged that some price increases exceeded the combined total of 6% for cost increases plus CPI adjustments.
The companies deny any wrongdoing but agreed to a $40,000,000 settlement to resolve the dispute and avoid the risks and costs of continued litigation.
Who Qualifies?

You were an open-market commercial or industrial customer
You had an automatically renewing written contract for waste hauling or recycling services with BFI Waste Services LLC or its affiliates
Your contract included a rate adjustment provision allowing certain price increases
You paid rate increases exceeding the combined total of 6% plus CPI increases

Some customers are excluded, including:
Customers under franchise agreements
Customers without a written contract
Contracts signed on or after April 4, 2021
Contracts with class action waivers or arbitration clauses
Customers who have already received credits or refunds offsetting price increases
How Much Money Could You Get?
Eligible class members can receive:
$100 if you submit a claim using your account number
$200 to $250 if you submit contract documentation
Contract claim payments depend on how many valid claims are filed:

When Will Payments Be Sent?
Payments are expected to be issued about 135 days after the court grants final approval of the settlement, assuming there are no appeals.
