If Avis notified you that your personal information was impacted in a 2024 data breach, you may qualify for money from a class action settlement.
The lawsuit claims Avis failed to adequately protect sensitive customer information during a data security incident that happened between August 3, 2024 and August 6, 2024.
What happened?
The case alleges that Avis experienced a data security incident that exposed certain customer information, including:
- Names
- Driver’s license information
- Credit card numbers and expiration dates
- Dates of birth
- Phone numbers
According to the lawsuit, cybercriminals accessed and exfiltrated personal information during the incident.
Plaintiffs argued Avis failed to adequately protect consumer data. Avis denies all allegations and says it did nothing wrong.
Who is eligible?
You may be included in the settlement if:
- You are a United States resident
- Avis notified you that your personal information was impacted in the data breach that occurred between August 3, 2024 and August 6, 2024
If you received a breach notification from Avis, you are likely part of the settlement class.
How much money can you get?
Eligible class members who submit a valid claim may receive:
Out-of-Pocket Loss Reimbursement – You can claim up to $5,000 for documented losses related to the data breach, including unreimbursed monetary losses more likely than not caused by the incident. Examples may include:
- Fraud-related expenses
- Identity theft losses
- Other documented financial harm tied to the breach
Pro Rata Cash Payment – All settlement class members who file a valid claim can also receive a cash payment from the remaining settlement fund. The final amount depends on:
- The total number of valid claims filed
- Approved expenses and fees
- Total approved out-of-pocket claims
You can claim the cash payment even if you do not have documented losses.
